Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of HostLink, a service provided by 36 Enterprises, LLC (“HostLink,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. The service

HostLink lets short-term rental hosts publish a digital guest guide (text, photos, videos) at a public URL and receive live video calls from their guests. Features, limits, and pricing may change over time.

2. Accounts

  • You must be at least 18 years old and able to enter into a contract.
  • You are responsible for your account credentials and everything that happens under your account.
  • Provide accurate information and keep it current. Notify us of any unauthorized use.

3. Your content

You retain ownership of the content you upload (photos, videos, text, property details, etc.). You grant HostLink a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, and display your content solely to operate and improve the Service, including delivering it to guests you invite or publish to.

You represent that you have all rights necessary to upload and share your content and that it does not violate any law or third-party right.

4. Guest data

When you use HostLink to interact with your guests, you are the controller of any personal information you collect from them through the Service. You agree to:

  • Publish an accurate description of your property and any house rules.
  • Comply with all applicable laws, including privacy, consumer-protection, short-term rental, and platform (e.g. Airbnb, Vrbo) rules.
  • Not misuse guest information you receive through the Service.

5. Acceptable use

You will not:

  • Use the Service for anything unlawful, harmful, deceptive, or infringing.
  • Upload malware or attempt to disrupt, probe, or reverse engineer the Service.
  • Post content that is sexually explicit involving minors, promotes violence, or violates the rights of others.
  • Use the Service to send unsolicited marketing to guests.
  • Resell, sublicense, or provide the Service to third parties without our written consent.

We may suspend or terminate accounts that violate these Terms.

6. Live calls and media hosting

HostLink routes live audio/video between hosts and guests using third-party infrastructure. Call quality depends on network conditions and devices. We do not record calls. Uploaded videos are processed and delivered via Cloudflare Stream.

7. Paid plans, billing, and refunds

  • Some features require a paid subscription. Fees, billing cycle, and included limits are shown at checkout.
  • Subscriptions renew automatically for successive periods until canceled. You can cancel from your account; cancellation takes effect at the end of the current billing period.
  • Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by the Paddle Buyer Terms.
  • We offer a 30-day money-back guarantee on new subscription purchases. See our Refund Policy for details on how to request a refund via paddle.net.
  • If a payment fails, we may suspend or downgrade your account until it is resolved.
  • We may change pricing on notice. Changes apply to the next renewal.

7a. Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

8. Trials and beta features

Free trials and beta features are provided as-is, may change or end at any time, and may have separate terms disclosed at signup.

9. Third-party services

The Service integrates with third-party providers (e.g. Supabase, Cloudflare, payment processors, listing platforms like Airbnb and Vrbo). Your use of those services is subject to their own terms. We are not responsible for third-party services.

10. Intellectual property

HostLink, its logos, and all Service software are owned by 36 Enterprises, LLC and its licensors. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose. All rights not expressly granted are reserved.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if the Service is discontinued. Sections that by their nature should survive (ownership, disclaimers, limitation of liability, indemnity, governing law, and dispute resolution) will survive termination.

12. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 36 ENTERPRISES, LLC AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AND (B) USD $100.

14. Indemnity

You agree to indemnify and hold harmless 36 Enterprises, LLC and its officers, employees, and agents from any claims, damages, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your content, or your violation of these Terms or any law or third-party right.

15. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. The state and federal courts located in California will have exclusive jurisdiction over any dispute not subject to arbitration, and you consent to personal jurisdiction there. Where permitted by law, you and HostLink waive any right to a jury trial and to participate in a class or representative action.

16. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll notify you (e.g., by email or in-product notice). Continued use after changes take effect constitutes acceptance.
